CITY OF MURPHY, TEXAS NOTICE/ORDER OF SPECIAL ELECTION 

CIUDAD DE MURPHY, TEXAS AVISO/ORDEN DE ELECCIÓN ESPECIAL

A special election is hereby ordered to be held on November 8, 2022, to consider propositions amending the City Charter. Por la presente se ordena que se llevará a cabo una elección especial el 8 de Noviembre 2022, para considerer las propuestas a la Ley Orgánica Municipal.

ELECTION DAY LOCATIONS, DATES AND TIMES

CENTROS DE VOTACIÓN, FECHAS Y HORAS PARA LA VOTACIÓN  EL DÍA DE LAS ELECCIONES

On Election day, November 8, 2022, eligible voters may vote  at the Murphy Community Center, 205 N. Murphy Road, Murphy, Texas, or any other Election Day Voting Center Locations listed on http://www.collincountytx.gov/elections/election_information from 7:00 a.m. to 7:00 p.m. El Día de las Elecciones, el 8 de Noviembre de 2022, votantes que cumplan con los requisitos podrán votar en el Centro Comunitario de Murphy, 205 N. Murphy Road, Murphy, Texas, o cualquiera de los Centros de Votación que se indica en http://www.collincountytx.gov/elections/election_information desde las 7:00 a.m. hasta las 7:00 p.m.

Proposition No. A

Shall the Charter’s Preamble be amended to provide that all citizens be treated with dignity and respect. 

 PROPOSICIÓN NRO. A

Se deberá enmendar el Preámbulo de la Carta Orgánica para disponer que todos los ciudadanos sean tratados con dignidad y respeto.

Proposition No. B 

Shall Charter Section 3.04 (Compensation) be amended to increase payment per City Council meeting to $75 per councilmember and $100 to the mayor or acting mayor.

PROPOSICIÓN NRO.B

Se deberá enmendar la Sección 3.04 de la Carta Orgánica (Remuneración) para aumentar el pago por cada asamblea del Consejo Municipal a $75 para cada miembro del consejo y $100 para el alcalde o alcalde interino.

Proposition No. C

Shall Charter Section 3.12 (Abstentions) be amended to clarify when a Councilmember abstains from a vote based on a conflict of interest, that conflict must meet the definition provided in Section 3.11 of the Charter.

 PROPOSICIÓN NRO.C

Se deberá enmendar la Sección 3.12 de la Carta Orgánica (Abstenciones) para aclarar que cuando un Miembro del Consejo se abstiene de votar en un conflicto de interés, ese conflicto debe cumplir con la definición provista en la Sección 3.11 de la Carta Orgánica.

PROPOSITION NO. D

Shall Charter Section 4.03(5) (Municipal Court) be amended to remove the City Manager’s authority to approve the appointment of the City Attorney or their designee as the City Prosecutor.

 PROPOSICIÓN NRO.D

Se deberá enmendar la Sección 4.03(5) (Tribunal Municipal) de la Carta Orgánica para eliminar la autoridad del Administrador de la Ciudad para aprobar la designación del Abogado de la Ciudad o la persona designada como el Procurador de la Ciudad.

PROPOSITION NO. E

Shall Charter Section 4.06(2)(E) (Personnel System) be amended to clarify which city employees are subject to annual evaluations.

 PROPOSICIÓN NRO.E

Se deberá enmendar la Sección 4.06(2)(E) de la Carta Orgánica (Sistema de personal) para aclarar qué empleados de la ciudad están sujetos a evaluaciones anuales.

PROPOSITION NO. F

Shall Charter Section 7.02 (Submission of Budget and Budget Message) be amended to provide that the budget prepared by the City Manager is submitted to the Council in compliance with state law. 

PROPOSICIÓN NRO.F

Se deberá enmendar la Sección 7.02 de la Carta Orgánica (Presentación del presupuesto y mensaje del presupuesto) para disponer que el presupuesto preparado por el Administrador de la Ciudad se presente ante el Consejo conforme lo dicta la ley.

PROPOSITION NO. G

Shall Charter Section 7.07 (Budget, Appropriation and Amount to be Raised by Taxation) be amended to clarify the City will base budget estimates of cash on hand using projected cash on hand.

PROPOSICIÓN NRO. G

Se deberá enmendar la Sección 7.07 de la Carta Orgánica (Presupuesto, apropiación y cantidad a ser elevada por los impuestos) para aclarar que la Ciudad basará los estimados del presupuesto de efectivo en mano usando el efectivo en mano proyectado.

PROPOSITION NO. H

Shall Charter Section 7.08 (Contingent Appropriation) be deleted to eliminate the use of contingent appropriations. 

 PROPOSICIÓN NRO. H

Se deberá borrar la Sección 7.08 de la Carta Orgánica (Apropiación contingente) para eliminar el uso de apropiaciones contingentes.

PROPOSITION NO. I

Shall Charter Section 7.09 (Amending the Budget) be amended to provide that budget amendments will be physically maintained in accordance with state law. 

 PROPOSICIÓN NRO. I

Se deberá enmendar la Sección 7.09 de la Carta Orgánica (Enmiendas del presupuesto) para disponer que las enmiendas del presupuesto se lleven a cabo físicamente como lo dicta la ley.

PROPOSITION NO. J

Shall Charter Section 7.18 (Independent Audit) be amended to require the City will issue Request for Proposals (RFP) for audit services every five years and clarify the current audit firm may compete, as allowed by state law. 

 PROPOSICIÓN NRO. J

Se deberá enmendar la Sección 7.18 de la Carta Orgánica (Auditoría independiente) para exigir que la Ciudad emita una Solicitud de propuestas (RFP) para servicios de auditoría cada cinco años y aclarar lo que la firma de auditoría actual puede completar, según lo permita la ley del estado.

PROPOSITION NO. K

Shall Charter Section 9.03(3) (Procedure) be amended to clarify when a Planning and Zoning Commissioner abstains from a vote based on a conflict of interest, that conflict must meet the definition provided in Section 9.03(2) of the Charter.

PROPOSICIÓN NRO. K

Se deberá enmendar la Sección 9.03(3) de la Carta Orgánica (Procedimiento) para aclarar que cuando un Comisionado de Planificación y Zonificación se abstiene de votar con base en un conflicto de interés, ese conflicto debe cumplir con la definición provista en la Sección 9.03(2) de la Carta Orgánica.

 PROPOSITION NO. L

Shall Charter Section 12.03(1) (Notice of Claim) be amended to add that a notice of claim may be filed with the Human Resources Department. 

 PROPOSICIÓN NRO. L

Se deberá enmendar la Sección 12.03(1) de la Carta Orgánica (Aviso de reclamación) para añadir que se puede presentar un aviso de reclamación al Departamento de Recursos Humanos.

PROPOSITION NO. M

Shall Charter Section 12.03 (2) (Notice of Claim) be amended to increase the deadline to file a notice of breach of contract claim against the City from thirty (30) days to ninety (90) days.

 PROPOSICIÓN NRO. M

Se deberá enmendar la Sección 12.03 (2) de la Carta Orgánica (Aviso de reclamación) para aumentar la fecha límite para presentar un aviso de reclamación de incumplimiento de contrato contra la Ciudad de treinta (30) días a noventa (90) días.

PROPOSITION NO. N

Shall Charter Section 12.03(3) (Notice of Claim) be amended to delete the requirement for non-binding mediation prior to an individual filing a claim against the City or initiating an arbitration proceeding against the City.  

 PROPOSICIÓN NRO. N

Se deberá enmendar la Sección 12.03(3) de la Carta Orgánica (Aviso de reclamación) para eliminar el requisito de mediación no obligatoria antes de la presentación individual de una reclamación en contra de la Ciudad o iniciar un proceso de arbitraje en contra de la Ciudad.

PROPOSITION NO. O

Shall Charter Section 14.01(2) (Nepotism) be amended to clarify that the nepotism provision applies to individuals serving on City Boards, Committees, and Commissions.

 PROPOSICIÓN NRO. O 

Se deberá enmendar la Sección 14.01(2) de la Carta Orgánica (Nepotismo) para aclarar que la disposición de nepotismo se aplica a individuos que brindan servicios en Consejos Municipales, Comités y Comisiones.
